On the report of the Minister of Infrastructure, Transport and Housing,
Because of the Civil Code;
Given the code of construction and housing, in particular Articles R. 111-1 and R. 111-2;
Considering the law n ° 67-561 of 12 July 1967 on the improvement of housing;
Considering Law No. 89-462 of July 6, 1989 to improve reporting rental and amending Law No. 86-1290 of December 23, 1986, in particular Articles 2 and 6 in the version resulting from Article 187 of Law No. 2000-1208 of 13 December 2000 on solidarity and urban renewal;
Considering Decree No. 68-976 of 9 November 1968 fixing the conditions of application of Law No. 67-561 of 12 July 1967 on the improvement of housing;
After consulting the National Board of Housing, dated May 10, 2001;
Given the opinion of the Regional Council of Guadeloupe on 31 August 2001, the General Council of Guadeloupe on 13 September 2001 and the General Council of the Meeting dated October 3, 2001;
Seen the letters of referral for the opinion of the Regional Council of French Guiana, Martinique Regional Council and Regional Council Meeting dated respectively 9 August 10 August 10 August 2001;
Seen the letters of referral for the opinion of the General Council of Guyana and the General Council of Martinique, respectively dated August 9 and August 10, 2001;

Housing is housing that meets the requirements defined by this Decree.
Housing must meet the following requirements, in terms of physical safety and health of tenants:
1. It provides closed and covered. The main structure of the housing and the access is in good condition and strength and protects against local runoff and upwelling. The external woodwork and cover with fittings and accessories provide protection against water infiltration into the house. For units in the overseas departments, it can be taken into account in assessing the conditions for protection against water penetration, weather conditions specific to these departments;
2. Restraint of persons in the dwelling and its approaches, such as windows, railings, staircases, loggias and balconies, are in a state consistent with their use;
3. The nature and state of preservation and maintenance of building materials, pipes and coatings housing show no obvious risks to health and physical safety of tenants;
4. Networks and connections of electricity and gas and heating equipment and hot water are consistent with the safety standards set by laws and regulations and are in good working order and operation;
5. The openers and residential ventilation allow air exchange adapted to the needs of a normal occupancy of housing and operation of equipment;
6. The main rooms within the meaning of the third paragraph of Article R. 111-1 of the Code of Construction and Housing, benefit from a sufficient natural light and giving an opening to the air or on a volume of glass overlooking the open air.
The accommodation consists of the equipment and comfort include:
1. An installation to a normal heating, equipped with the devices power supply and evacuation of combustion products and suitable for housing characteristics. For units in the overseas departments, it can not be made under these provisions when conditions warrant;
2. Installation of water supply in ensuring housing delivery with a pressure and flow sufficient for normal use of its tenants;
3. Facilities for domestic waste water and sewage discharge preventing odors and effluents and equipped with traps;
4. A kitchen or kitchen area in order to receive a cooking appliance including a sink connected to a supply system hot and cold water and installation of a sewage disposal;
5. A sanitary facility inside the dwelling including a toilet, separate kitchen and the room where meals are eaten, and equipment for washing, including a bath or shower, built to ensure the personal privacy, supplied with hot and cold water and fitted with a waste water disposal. Washroom accommodation in one piece may be limited to a toilet Outside housing provided that the toilet is located in the same building and easily accessible;
6. An electrical system providing adequate lighting in all rooms and access and the operation of common household appliances essential to everyday life.
Into the slots in the overseas departments, the provisions relating to the hot water provided for 4 and 5 above shall not apply.
The housing has at least one main room with either a living area of at least 9 square meters and a ceiling height of at least 2.20 meters, a living space of at least 20 cubic meters.
The living space and living space are determined in accordance with the second and third paragraphs of Article R. 111-2 of the Code of Construction and Housing.
Housing that is the subject of a notice of inadequacy or danger can not be regarded as decent housing.
The improvements provided for in Article 1 of the Act of July 12, 1967 referred to above are those which are intended exclusively to the premises in compliance with all or part of the provisions of Articles 1 to 4 of this Decree, without reaching exceed the defined therein.
Articles 1, 5-14 and 17 of the decree of November 9, 1968 referred to above are hereby repealed.
The Keeper of the Seals, Minister of Justice, the Interior Minister, the Minister of Infrastructure, Transport and Housing, the Secretary of State for Overseas and Secretary of State for Housing are responsible, each in his case, the execution of this Decree, to be published in the Official Journal of the French Republic.
