ACT No. 2009-974 of August 10, 2009 reaffirming the principle of Sunday rest and to adapt the exceptions to this principle in the municipalities and tourist areas and hot and in some major cities for volunteer employees (1)
The National Assembly and the Senate passed,
Considering the decision of the Constitutional Council No. 2009-588 DC of August 6, 2009;
The President of the Republic promulgates the law which reads as follows:
I to III and V to VII. - Changed the following:
- Labour CodeArt. L3132-3 , Art. L3132-23 , Art. L3132-25 , Art. L3132-13
Created the following:
- Labour CodeArt. L3132-25-1 , Art. L3132-3-1 , Art. L3132-25-2 , Art. L3132-25-3 , Art. L3132-25-4 , Art. L3132-25-5 , Art. L3132-25-6
A repealed the following provisions:
- Labour CodeArt. L3132-21
IV. - In the shops or branches covering retail and in retail shops or services, where administrative exemptions apply to Sunday rest, professional organizations or the employer, on the one hand, and the representative trade unions, d Second, enter into negotiations for the signing of an agreement counterparties granted to employees of private rest Sunday when the branch or company is not already covered by an agreement.
Articles 1 and 2, with the exception of I of Article 2 shall not apply in the departments of Moselle, Bas-Rhin and Haut-Rhin.
A committee composed of three parliamentarians from the majority and three parliamentarians from the opposition, is responsible for ensuring compliance with the principle of Sunday rest placed at the article L. 3132-3 of the Labour Code .
This committee shall report to Parliament within a period of one year from the date of publication of this Act.
This law shall be enforced as a law of the state.
