Law No. 2011-525 of 17 May 2011 to simplify and improve the quality of law (SAQD) shall include a provision on the development status of pets.

For this reason in particular, a mechanism for identifying cats over seven months is established.

Similarly, the approval is removed by the state agencies for the selection of canine and feline species.

Conversely, the application of the warranty against hidden defects sales of domestic animals was eventually rejected by Parliament, on behalf of the defense of the French horse industry.

1. Identification of cats over seven months

It will be recalled that Article L. 212-10 of the Code rural and sea fishing already provides that dogs and cats must be identified by tattoo prior to sale, and even if the sale takes place free of charge.

This identification is also required outside of any assignment for the dogs born after January 6, 1999 and aged over four months.

Similarly, the identification is mandatory for all domestic carnivores in the departments officially reported infected with rabies.

Finally, the identification requirement can be extended and adapted to non-domestic animal species protected.

Article 28 of the Act extends this requirement to SAQD tattoo identification for all cats over seven months, born after 1 January 2012.

To justify this measure, it was pointed out by parliamentarians that over 80% of cats in France were not tattooed, and that "their proliferation was a source of recurring problems" such as lack of space to accommodate the cats in shelters, increased collection costs and the spread of euthanasia in certain geographic areas without the owner knowing it.

2. Abolition of the authorization by the State agencies for the selection of canine and feline species

Article 33 of Law SAQD, introduced at the initiative of the Government, removes the approval by the State agencies for the selection of canine and feline species, responsible for defining selection objectives or plans of crossing and of ensure the maintenance of herd books or records of livestock breeds (amendment to Article L. 653-3 of the Code rural and sea fishing).

Monitoring of licenses became apparent too heavy by the government.

For this deletion, it was also noted that Article L. 214-8 of the Code rural and marine fisheries already provided that any sale of pets carried out as part of management activities of a pound or shelter, breeding, exercise as commercial sales activities, transit or storage, education, training and public presentation of dog and cat or an animal protection association or a foundation dedicated to the protection of animals must be accompanied at the time of delivery to the purchaser of the issue:

a certificate of transfer; a paper on the characteristics and needs of the animal also containing, if necessary, boards of education and for the sale of dogs, a veterinary certificate in conditions defined by decree.

The same article also states that can not be called as a dog or cat belonging to a race that dogs and cats registered in a studbook recognized by the Minister for Agriculture.

It shows that a system of official reference breeds dogs and cats is therefore maintained, which seems particularly necessary for dangerous dogs.

3. Refusal of the systematic extension of the warranty against hidden defects sales of pets

It was originally envisaged by Parliament to allow the systematic application of the warranty against hidden defects of the Civil Code (articles 1641 et seq) to all sales of domestic animals, regardless of the vendor qualification - professional or not -.

Given the difficulties and possible claims that may be created as part of the horse sales, including auctions, because of the time for appeal, this article was eventually rejected by Parliament, to the extent that it would have been likely to weaken the French horse industry.
