What is the Defender of Rights?

The Defender of Rights is an independent constitutional authority that enforces the rights and freedoms by any person, public or private.

What is it loaded?

• defend the rights and freedoms in the context of relations with public services,
• to defend and promote the interests and rights of the child,
• to fight against discrimination prohibited by law and to promote equality,
• to ensure respect for ethics by those engaged in security.

According to the Organic Law No. 2011-333 and No. 2011-334 ordinary act of March 29, 2011, the Defender of Human succeeds Ombudsman, the Children's Ombudsman, the High Authority against Discrimination and for Equality (HALDE) and the National Commission on Security Ethics (NSDC) as of 1 May 2011.

Who can enter? How?

• Any person aggrieved by the operation of an administration or public service:

• A child who invokes the protection of its rights or a situation involving his interest, or his legal representative, a family member, a medical or social, or association rights of the child:

• Any person who considers himself a victim of discrimination, direct or indirect, prohibited by law or an international commitment that the alleged discrimination that is a private person or public:

• Anyone who was a victim or witness of facts which it considers to constitute a breach of ethics by persons engaged in security (national police, gendarmerie, municipal police, prison service, customs service, private security service monitoring of public transport, etc..)

The Defender of Rights may also take up automatically or be seized by the dependents of the person whose rights and freedoms are at stake.

Referral to the Ombudsperson for interrupt or suspend the statute of limitations in civil actions, administrative or criminal, nor those of administrative remedies and litigation.
