Sex and earnings

First and foremost is a question of definition. In other words, what is prostitution and what is a person prostitute? In law, the regime of the latter is defined by a decree of November 5, 1947: the activity of a person who consents usually have sex with an unknown number of individuals for a fee. Places of prostitution

Regarding freedom of prostitution in all places, the police authorities generally may, under traffic, regulate the movements of professional prostitute (s) on the road but the regulation can lead to a general prohibition and absolute (Cass. crim. 02.01.56).
The prohibitions apply only if certain areas (near schools, for example) or certain hours.
Finally, criminal sanctions punish especially soliciting and procuring.

Soliciting

A decree of November 25, 1960 defines solicitation: attitude displayed in public to cause debauchery. On the basis of this text, tens of thousands of minutes have been prepared each year. Available as imprecise arbitrary: the mere presence of the prostitute in the street was sometimes punished.
The New Penal Code (1993) retains only soliciting active: the fact by any means of publicly soliciting others to encourage them to have sex is punishable by a fine for contraventions of the fifth class, namely F 10,000, 20,000 for repeat offenses. But the Homeland Security Act of January 21, 2003 radically changed the deal in this area.
